8:45-10:15 The NACDL Strike Force Martin Pinales

Martin Pinales, the Second Vice-President of the National Association of Criminal Defense Lawyers, will discuss the NACDL Strike Force and how it has been used to assist lawyers when they are faced with subpoenas, a contempt citation, or a motion to disqualify.

10:15-11:15 Ethics and the Rule of Law Charles Kettlewell

Charles Kettlewell has been retained in more than 750 disciplinary cases, and more than 125 admissions cases. He has written over 1600 private advisory opinions , and has been an expert witness or consultant in more than 195 legal malpractice cases. He was the 2003 recipient of The Michael Franck Award, presented by ABA Center For Professional Responsibility, and has been a member of the Editorial Board for the ABA/BNA Lawyers Manual on Professional Conduct since 1996. He will be discussing the importance of a viable system of legal ethics to the rule of law.

11:30-12:30 Public Defender Systems in the United States Catherine Beane

Catherine Beane is the Indigent Defense Counsel for the National Association of Criminal Defense Lawyers, and directs their indigent defense efforts, including development of systemic litigation, public education campaigns, and legislation aimed at improving state and local public defense systems. She will be discussing the various types of public defender systems presently in use throughout the United States.

9:15-10:30 The Future of Criminal Defense Gerry Goldstein

Gerry Goldstein is well known to criminal defense lawyers. Past President of NACDL, and a 1991 Heeney Award winner, he served as amicus curiae for NACDL in many high-profile cases, including CNN v. Manuel Noriega (1990), opposing network broadcasting of government tapes of Noriega's conversations with his attorneys. Gerry will discuss his views on the current and future state of criminal defense practice in our social and political climate.

10:45-12:00 Defending Jose Padilla Donna Newman

Donna Newman is an attorney practicing criminal defense in New York. She has been the attorney for Jose Padilla since his arrest in June of 2002. The Padilla case, now on appeal to the United States Supreme Court, will determine the authority of the Executive Branch to detain United States citizens incommunicado without trial as “enemy combatants.”

1:15-2:30 Trial Preparation: White Collar Crimes and Otherwise Bruce Maloy

Bruce Maloy is a partner in the Atlanta, Georgia firm of Maloy and Jenkins. Bruce specializes in complex criminal cases, including acting as lead defense counsel in major prosecutions for healthcare fraud, band fraud, money laundering, racketeering, and other fraud related cases. Bruce is an expert in international criminal law and extradition matters, teaches International Criminal Litigation at Emory University, and is actively involved in pro bono death penalty litigation. He will be presenting his method of trial preparation in white collar crime cases, with ideas of how to adapt his system for any criminal case.

2:45-3:45 The Law of Contempt James Park Taylor

A review of the law of contempt in state and federal court and the relationship of the issue to the Rules of Professional Conduct. Includes practical advice for the courtroom, and a sample writ of habeas corpus for that special occasion.
