Bio

Tony Gallagher

 

Anthony R. (Tony) Gallagher was born in 1949 in central Pennsylvania. He graduated with distinction from Duquesne University, Pittsburgh, in 1971, and the University of Baltimore School of Law, Baltimore, Maryland, in 1977, following service in the United States Army during the latter stages of the Viet Nam conflict.

 

He has practiced primarily criminal law throughout his career in both public and private positions.  In Septemeber 1992 he was selected as the first Executive Director of the Federal Defenders of Montana, Inc., and Federal Defender for the District of Montana. The Federal Defenders of Montana, Inc., established under Title 18, United States Code, section 3006A, is a Community Defender Organization providing criminal defense services and representation to those who cannot otherwise afford counsel in federal court. As an active litigator, Tony has taken part in more than four hundred jury and non-jury trials, with significant state and federal appellate experience. Among his notable clients while in Montana are Leroy Schweitzer (avowed leader of the Montana “Freemen”) and “Unabomber” Theodore Kaczynski (in the early stages of litigation).

 

Tony has testified as an expert witness in several trials or post-conviction proceedings as a specialist in criminal defense. He has been an adjunct professor at The George Washington University (Criminal Law, Evidence) and Catholic University’s Columbus School of Law (Criminal Law, Trial Advocacy); a guest lecturer at the University of Baltimore, the University of Montana, Georgetown University, the University of Maryland and the University of Wisconsin; and a featured speaker at national and regional training programs sponsored by the Administrative Office of the United States Courts, the Federal Judicial Center, several bar associations and various defender organizations.

 

Tony has been a member of the Montana Association of Criminal Defense Lawyers since its inception. He was named that organization's Criminal Defense Lawyer of the Year in 2005.  He currently serves on a number of national committees and groups under the auspices of the Administrative Office of the United States Courts: Chair of the Community Defender Organization Working Group (CDOWG) and  member of the Defender Services Advisory Group (DSAG), the Defender Organization Classification System (DOCS) Expert Panel, and Joint Electronic Technology Working Group (JET-WG).  He has been assigned on an ad hoc basis as an advisor for the Federal Defender Compensation Study.  Involved in a number of local committees, he most recently served on the United States District Court's subcommitte on discovery rules and on two Magistrate Judge Selection Committees.

 

He has been a high school and small college football official and an American Legion Baseball umpire for more than thirty years.
